Paragraph 7 Items or "Walk Through Items"
In a normal home sale that makes use of the Regional Sales Contract the buyer and seller agree that certian elements of the house or condo will be in normal working order.
Paragraph 7 of the Regional Contract states:
"Purchaser accepts the Property in the condition as of the Contract Date except as otherwise provided herein. Seller warrants that, except as otherwise provided, the existing appliances, heating, cooling, plumbing, electrical systems and equipment, and smoke and heat detectors (as required), will be in normal working order as of the Possession Date. Seller will deliver the Property in substantially the same condition as on the Contract Date and broom clean with all trash and debris removed. Purchaser and Seller will not hold the Broker liable for any breach of this paragraph. Seller will have all utilities in service through Settlement or as otherwise agreed"
Required Fixes
Assuming that the buyer and seller have not altered Paragraph 7 of the Regional Sales Contract, the seller would then be required to fix any outstanding issues related to the:
- Appliances
- Heating and Cooling,
- Plumbing
- Electrical Systems and Equipment
- Smoke and Heat Detectors.
So if any of those items were found to not be in normal working order during the home inspection or at any time leading up to settlement, the purchaser would simply send a notice to the seller to let them know they need to fix each of those items. Because paragraph 7 will have been agreed to prior to the home inspection, the buyer will not need to ask for any of those items to be fixed, they will simply identify them as a courtesy to the seller.
Negotiable Home Inspection Items
All other items outside of the scope of Paragraph 7 are Negotiable Home Inspection Items.
